The area of approximately 0.052 ha of land edged red on the plan is available subject to outline planning approval for the erection of two single storey dwellings.

CONDITIONS AND ASSOCIATED REASONS:
The proposed development is in accord with the following development plan policies and there are no other material considerations that outweigh those listed development plan policies.
Ryedale Local Plan – Policy H7 – Residential developments within settlements
01 Application for approval of reserved matters shall be made to the Local Planning Authority no later than 6 September 2008.
The development hereby permitted shall be begun on or before whichever is the later of the following dates:
(i) 6 September 2010
(ii) The expiration of two years from the final approval of the reserved matters or (in the case of approval on different dates) the final approval of the last such matters approved.
Reason:- To ensure compliance with sections 91 to 95 and Section 56 of the Town & Country Planning Act 1990.
02 No development shall take place without the prior written approval of the Local Planning Authority of all details of the following matters:
(i) The siting, design and external appearance of every building, including a schedule of external materials to be used
(ii) The means of access to the site
(iii) The landscaping of the site
Reason:- To safeguard the rights of control by the Local Planning Authority in respect of the reserved matters.
03 Before the development hereby permitted is commenced, or such longer period as many be agreed in writing with the Local Planning Authority, details and samples of the materials to be used on the exterior of the building the subject of this permission shall be submitted to and approved in writing by the Local Planning Authority.
(NB Pursuant to this condition the applicant is asked to complete and return the attached proforma before the development commences so that materials can be agreed and the requirements of the condition discharged)
Reason:- To ensure a satisfactory external appearance and to satisfy the requirements of Policy H7A(ii) of the Ryedale Local Plan.
04 Prior to commencement of the development hereby permitted, the developer shall construct on site for the written approval of the Local Planning Authority, a one metre square free standing panel of the external walling to be used in the construction of building. The panel so constructed shall be retained only until the development has been completed.
Reason:- To ensure a satisfactory external appearance and to satisfy the requirements of Policy H7A(ii) of the Ryedale Local Plan.
05 Before the commencement of the development hereby permitted, or such longer periods as may be agreed in writing with the Local Planning Authority, full details of the materials and design of all means of enclosure shall be submitted to and approved in writing by the Local Planning Authority. Thereafter these shall be erected prior to occupation of any dwelling to which they relate.
Reason:- To ensure that the development does not prejudice the enjoyment by the neighbouring occupiers of their properties or the appearance of the locality, as required by policy H15 of the Ryedale Local Plan.
06 Not withstanding the provisions of Schedule 2, Part 1 of the Town and Country Planning (General Permitted development) Order 1995 (or any Order revoking, re-enacting or amending that Order), development of the following classes shall not be undertaken other than as may be approved in writing by the Local Planning Authority following a specific application in that respect:
Class A: Enlargement, improvement or alteration of a dwelling house
Class B: Roof alteration to enlarge a dwelling house
Class C: Any other alteration to the roof of a dwelling house
Class D: Erection or construction of a domestic external porch
Class E: Provision within the curtilage of a dwelling house of any building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of a dwelling house or the maintenance, improvement or other alteration of such a building or enclosure.
Reason:- To ensure that the appearance of the area is not prejudiced by the introduction of unacceptable materials and/or structure(s) and to satisfy Policy H7A criteria (i) and (ii) of the Ryedale Local Plan.
07 Prior to the commencement of any part of the development hereby permitted the access to the site shall be laid out and constructed in accordance with the following requirements:-
ic) crossing of the highway verge and/or footpath shall be constructed in accordance with the Specification of the Local Highway Authority.
vi) any access gates shall be made to open inwards only. Note: It is an offence under Section 153 of the Highways Act1980 to permit any door, gate or bar to open outwards across a highway.
Reason:- To ensure a satisfactory means of access to the site from the public highway, in the interests of vehicle and pedestrian safety and convenience and to satisfy the requirements of Policy T3 of the Ryedale Local Plan.
08 The development shall not be commenced until full details of the proposed vehicular access, parking and turning arrangements have been submitted to and been approved in writing by the Local Planning Authority in consultation with the Local Highway Authority. Those arrangements shall be constructed in accordance with the specification so approved before the development is first brought into use unless otherwise approved in writing by the Local Planning Authority. Once created these areas shall be maintained clear of any obstruction and retained for their intended purposes at all times.
NOTE:- You are advised that prior to any works commencing permission is required from North Yorkshire County Council as the Local Highway Authority for all works within the public highway. The applicant should contact NYCC Development Control at Pickering Area Office, Southgate, Pickering, YO18 8BL Tel 01751 472031, which will provide the details constructional specification, list of approved contractors, forms, etc referred to in the Condition on the Planning Approval.
Reason:- To ensure appropriate on-site vehicle parking facilities with associated access and manoeuvring areas, in the interests of highway safety and the general amenity of the development and to satisfy the requirements of Policy H7A(iii) of the Ryedale Local Plan.

It is advised that due to the proximity of the neighbouring dwellings, particularly those to the west of the site, any proposed dwelling should be of a single-storey design. Any dwelling should be sited in a manner so as not to result in overlooking of neighbouring property. The applicant is therefore advised to contact the Local Planning Authority to discuss design issues prior to submitting a reserved matters application.
NOTE:
Vehicular access to be agreed with interested parties.
